Denmark, France, Hungary, Lithuania and Portugal support the agreement for a partial general approach on the text of the Seventh Framework Programme of the European Community (EC) with a view to a timely adoption of the entire body of legal texts for the Framework Programme. However, concerning the European Research Council (ERC), they want to express the following views: 15031/05 THB/DGE/ep 14 DG C II EN - Europe needs an independent ERC as a permanent institution, with legal capacity. The ad hoc ERC structure proposed by the European Commission does not respond to these criteria and can only be accepted as an interim solution. - There is therefore a need for a timely, comprehensive and independent analysis of the best legal base for the European Research Council (ERC). - This analysis should take place as soon as possible and be conducted with Article 171 as a preferred legal base for the ERC in order to achieve a high degree of autonomy and independence from the European Commission and other European institutions. - Full autonomy and independence of the ERC should be guaranteed from the beginning. In particular, the Director and senior staff of the ERC during its first phase, although formally nominated by the European Commission, should be chosen by and report to the ERC Scientific Council. - Within the framework of an executive agency structure for the implementation of the ERC, these countries urge the Commission to respect fully the decisions of the ERC Scientific Council.
