Sweden endorses, with one significant exception, the content of the Seventh Framework Programme for Research as it is cast in the partial general approach. The exception concerns the legal ground for the European Research Council. The purpose of the ERC is to promote world class quality of European research in general. This requires a confidence in the scientific society, which only can be achieved through a high degree of autonomy from the European Commission and other European institutions. The decision now taken has not been preceded by a thorough analysis of alternative ways of reaching that autonomy and it has not been possible to conduct a constructive debate. Sweden is of the opinion that Article 171 of the Treaty as a legal ground for ERC would make it possible to give the ERC a legally independent capacity for decision making, thus creating the autonomy required. The review of the organization for ERC that is foreseen in the partial general approach should therefore be conducted with the Article 171 as legal ground for the ERC stated as the main alternative for the permanent structure. The review should also take place at earliest possible date and not later than 2008. It should therefore be noted in the Council minutes that Sweden cannot support the decision on the partial general approach.
