Commissie verzoekt Oostenrijk Europese regels rond optische straling in acht te nemen (en)

The European Commission has asked Austria to adopt all the measures necessary to comply with the EU legislation that protects workers from health and safety risks of excessive exposure to 'artificial optical radiation', such as laser equipment and ultraviolet A light (UVA)(Directive 2006/25/EC). This radiation can provoke eyes and skin damage. The request takes the form of a 'reasoned opinion' under EU infringement procedures. Austria now has two months to comply. The Commission may decide to refer it to Court of Justice of the EU if action to ensure compliance is not taken.

The Optical Radiation Directive (2006/25/EC) lays down minimum requirements to protect workers from the health and safety risks associated with optical radiation, in particular damage to the eyes and to the skin. Optical radiation can arise where workers are exposed to lasers, UVA and other specific forms of artificial light, both visible and invisible. It presents a particular risk to workers' health and safety in sectors such as metalwork and welding where lasers and other devices are regularly used in work processes.

The Directive foresees exposure limit values based on established health effects and biological considerations. It also requires employers to determine the levels of optical radiation in workplaces and assess the risks, to avoid or reduce risks to workers, to take preventive and protective measures and to provide information and training.

The Member States should have implemented the Directive by 27 April 2010. Austria has not yet notified the Commission of all the transposing measures to introduce these requirements. Therefore, the Commission is sending a reasoned opinion to the Austrian authorities, asking them to comply with their legal obligations. The Commission may decide to refer Austria to Court if action to ensure compliance is not taken.
