De Commissie verzoekt Italië, Zweden en Finland om de regels over aërosolautomaten na te leven (en)
The European Commission i has today decided to request Italy, Sweden and Finland to implement in full revised EU i rules on aerosol dispensers (Directive 75/324/EEC and its amendments). So far, Italy and Sweden have not implemented the relevant EU rules at all and Finland needs to implement them within the Province of Aland. The requests take the form of reasoned opinions under EU infringement procedures. If the Member States i concerned do not inform the Commission within two months of measures taken to ensure full compliance with their obligations under the Directive, the Commission may decide to refer them the EU's Court of Justice i.
The Directive in question protects consumers by requiring that aerosol dispensers marketed under its provisions must meet its safety requirements. It also ensures that those aerosol dispensers that meet these safety requirements can be sold legally in all EU Member States without restrictions.
The updated EU Directive ensures that the rules ensuring the safety of aerosol dispensers found on the EU market take into account recent technical progress and innovation. For example, the new Directive adapts the flammability criteria of aerosols in order to cover not only the substances but also the final product itself. It also defines harmonised test methods and criteria for the classification of flammable aerosols. It introduces alternatives to the hot water bath test, thus allowing for the marketing of heat-sensitive aerosols. It increases the maximum allowable pressure for aerosols not containing flammable gases in order to support the use of environmentally friendly propellants, while preserving consumer safety and it adjusts the filling levels of aerosol dispensers in order to better ensure consumer safety.
Member States had to adopt and publish the laws, regulations and administrative provisions necessary to comply with the Directive by 29 October 2009 and apply them as from 29 April 2010.
