European Commission i has requested Italy to notify national implementing measures as required by the plant health Directive (2010/1/EU i). The Commission has also requested Portugal to notify national implementing measures as required by Directive 2009/36/EC i on cosmetics. The request takes the form of a "reasoned opinion" under EU Infringement procedures. In the absence of a satisfactory response within two months, the Commission may decide to refer the above-mentioned Member States to the EU's Court of Justice i.
Italy
Italy has not communicated the measures implementing Directive 2010/1/EU.
Directive 2010/1/EU lays down protective measures against the introduction into the Community of organisms harmful to plants or plant products, and against their spread within the Community. Member States were obliged to implement it by February 28, 2010. The EU plant health legislation aims to ensure protection against harmful organisms that affect plants or plant products so that those products can be traded safely.
Portugal
Portugal has not communicated the measures implementing Directive 2009/36/EC amending Directive 76/768/EEC concerning cosmetic products. One of the objectives of Directive 76/768/EC is to ensure a high level of protection of human health. The Commission is currently evaluating hair dye substances in order to ensure that only safe substances are used in hair dye products. Directive 2009/36/EC definitively regulates 17 hair dyes on the basis of risk assessment opinions of the Scientific Committee on Consumer Products (SCCP).
The Commission initiated the infringement procedure, described in Article 258 of the Treaty on the Functioning of the European Union (TFEU), early this year by sending a letter of formal notice to both Italy and Portugal. By the sending of a "Reasoned Opinion", the Commission formally requests Italy and Portugal to take action to comply with EU law within a period of two months. The Commission may decide to refer the above-mentioned Member States to Court if action to ensure compliance is not taken.
