Interne Markt: niet-malevingsprocedures tegen Luxemburg en Griekenland (en)

The European Commission has decided to pursue infringement proceedings against Luxembourg concerning implementation of a Public Procurement Directive and against Greece concerning rules on the provision of postal services.

Public procurement - Luxembourg

In the absence of a satisfactory response to the Letter of Formal Notice addressed to the Luxembourg authorities on 23 September 2008, the Commission has decided, under Article 228 of the EC Treaty, to send a reasoned opinion to Luxembourg requesting it to comply immediately with the judgment of the European Court of Justice in the case C-268/07. The Court stated in this judgment that Luxembourg had not transposed directive 2004/17/EC, and had therefore failed to comply with its obligations under the EC law. The deadline for transposition of the Directive expired on 31st January 2006. To date, the Commission has still not received any implementing measures from the Luxembourg authorities.

Postal services - Greece

The Commission has decided to send a reasoned opinion to Greece concerning the continued application of a Ministerial Decision adopted in 2005 on licences for trucks for use in the postal sector, which, in the Commission's view, is contrary to the provisions of the EU Postal Directive. The Decision imposes restrictions and administrative burdens on enterprises currently providing postal and courier services in Greece and constitutes a barrier to entry for service providers wishing to provide such services.
