Joint Statement on EU Enlargement and Russia-EU relations

In view of Bulgarian and Romanian accession to the EU as of 1 of January 2007, we confirm our decision to extend the PCA to the two new Member States of the EU through an additional protocol which has been signed today. In this context, and taking into account the substantial work which has already been done:

  • 1) 
    We take note of the finalisation of the negotiations on a new Agreement between the Russian Federation and the European Community on trade in certain steel products. We confirm that traditional Russian exports to Romania and Bulgaria and the needs of two steel plants in Romania with Russian investment are taken into account.
  • 2) 
    The European Union takes note of the concerns expressed by Russia regarding the application of the existing EU anti-dumping measures to imports from Russia into Bulgaria and Romania upon their accession to the EU, including anti-dumping measures concerning imports of potassium chloride, ammonium nitrate, steel ropes and cables, and seamless pipes and tubes. The European Commission gives notice that it is prepared to review any anti-dumping measures concerning imports from Russia, where requested by interested parties with sufficient evidence to initiate such reviews in accordance with EU legislation and the PCA.

The European Union confirms that since 1 January 2007, all trade defence measures that were applied by Bulgaria and Romania on imports from third countries, including Russia, have ceased to exist.

  • 3) 
    The European Union confirms that application of the Memorandum on veterinary certificates for live Animals and Products of Animal Origin Designated for Export to Russia from the EU of 2 September 2004, Memorandum on Phytosanitary certificates of 15 March 2005 and the Annex to the Memorandum on Veterinary Certificates for transportation of products of Animal Origin from the EU and Transit of such Products through EU territory to the Russian Federation of 4 April 2006 as well as the Memorandum concerning principles of zoning and regionalization in the veterinary field of April 2006 is extended to Bulgaria and Romania as of 1 January 2007.

We welcome Annex II to the Memorandum of 2 September 2004, signed on 19 January 2007 concerning veterinary certification of animals and animal products. We reaffirm our commitment to avoid any unnecessary disruption of trade in products of animal and plant origin and to prior notification of restrictive measures followed by consultations, without prejudice to cases arising from urgent problems of health protection. Measures applied should be proportionate to the health risk.

  • 4) 
    We reconfirm our wish to conduct mutual consultations on trade conditions of agricultural goods between the Russian Federation and the enlarged EU inter alia in the framework of the newly created structured dialogue on Agriculture, notably with regard to traditional agricultural exports to Romania and Bulgaria. Country allocations within existing tariff quotas on grain can be envisaged in compliance with relevant WTO rules. We will also conduct consultations, in accordance with our obligations under the PCA, before introducing measures which could negatively influence the conditions of trade for these goods.
  • 5) 
    The European Commission confirms that existing bilateral agreements in the nuclear field, as well as contracts for nuclear material delivery and for nuclear fuel cycle services concluded by the Russian Federation with the acceding countries or between individuals or enterprises prior to accession, will remain valid provided that they are duly notified according to the provisions of the Euratom Treaty.

The European Commission confirms that contracts on nuclear material delivery and nuclear fuel cycle services to be concluded by Member States should comply with the provisions of the Euratom Treaty.

    We confirm our commitment to ensure adequate and effective protection and enforcement of intellectual, industrial and commercial property rights.
